Terms of Service

These terms are an agreement between you and Chris Johnson, doing business as Gearloom (“Gearloom”, “we”, “us”). They cover your use of Gearloom: the back office at app.gearloom.app, the websites we host for shops, and gearloom.app. By creating an account or using Gearloom, you agree to them on behalf of yourself and the business you sign up (“your shop”). If you don't agree, don't use Gearloom.

1. What Gearloom is

Gearloom is software for auto service businesses: a website for your shop, an inbox for enquiries, quotes, invoices, booking, follow-ups, a customer portal, warranties and reminders, and related tools. Features differ by plan and may change over time; we describe the current plans on our pricing page.

2. Your account

  • You must be at least 18 and able to agree to these terms for your shop.
  • Give us accurate information and keep it current. Keep your password to yourself; you are responsible for what happens under your logins, including your team's.
  • The shop's owner controls the account, its team members and its subscription.
  • Tell us at support@gearloom.app straight away if you think an account has been used without permission.

3. Plans, trials and payment

  • Free trial. New shops get one free trial of 14 days. Starting it requires a payment card. Unless you cancel before it ends, your subscription starts and your card is charged for the plan you chose.
  • Billing. Subscriptions are billed in advance, monthly or yearly, and renew automatically until cancelled. Payments are processed by Stripe; we don't store your card details.
  • Changing or cancelling. You can change plan or cancel at any time in Settings. A cancellation takes effect at the end of the period you've paid for. Except where the law requires otherwise, we don't refund partial periods.
  • Failed payments. If a payment fails we retry it for a period. If it still can't be collected, your subscription ends and your shop moves to the Starter plan's limits or is suspended until payment is made.
  • Price changes. We'll give you at least 30 days' notice by email before a price change applies to your subscription. It takes effect at your next renewal after the notice period.
  • Prices don't include taxes; you're responsible for any that apply.

4. Your data

Your shop's data (its customers, vehicles, messages, quotes, invoices, website content and so on) belongs to your shop. You give us permission to store, process, display and transmit it only as needed to run Gearloom for you, including sending the emails and hosting the website you ask us to. We don't sell it. How we handle personal information is described in our Privacy Policy.

Your customers' information is information you are responsible for. You confirm you have the right to give it to us and to contact the people in it the way you choose to through Gearloom.

5. Contacting your customers

Gearloom sends emails and other messages on your shop's behalf. You are responsible for having each person's permission where the law requires it, and for complying with the laws that apply to your messages, including the CAN-SPAM Act and, for text messages, the Telephone Consumer Protection Act. Honour unsubscribe and stop requests; Gearloom records them and won't send marketing to people who have opted out.

6. Your website and domain

  • We host your shop's website at an address on gearloom.app and, on plans that include it, on a domain you own.
  • A domain you connect stays yours. You keep it registered and its DNS pointed at us; if it lapses or moves, the site stops answering there.
  • You are responsible for the words, photos and logos you publish, and confirm you have the right to use them. We may remove content that breaks these terms or the law.

7. Acceptable use

Don't use Gearloom to:

  • break the law, or help anyone else to;
  • send spam, or messages to people who haven't agreed to receive them where consent is required;
  • publish anything misleading, infringing, defamatory, or harmful;
  • try to access other shops' data, test or bypass our security, or disrupt the service;
  • copy, resell or reverse engineer Gearloom, or use it to build a competing product.

8. Other services

Some features work through services you connect, such as Square for your customers' payments, Google Calendar, or Mailchimp. Your use of those services is governed by their own terms, and payments your customers make through Square go to your Square account, not to us. We aren't responsible for those services. If your shop turns on the AI assistant, the information it works on is processed by our AI provider as described in our Privacy Policy.

9. Availability and changes

We work to keep Gearloom running and secure, but we can't promise it will always be available or free of errors. We may improve, change or remove features. If we remove something central to a paid plan, we'll tell you in advance.

10. Ending your account

You can cancel at any time. We may suspend or close an account that breaks these terms, doesn't pay, or puts others at risk; where we reasonably can, we'll warn you first. After an account closes, you can ask us for a copy of your shop's data within 30 days; after that we may delete it, except where we must keep it by law.

11. Disclaimers

Gearloom is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Gearloom is a tool: the quotes, prices, warranties and messages you send are yours, and you are responsible for them.

12. Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to Gearloom is limited to the amount you paid us in the 12 months before the claim arose.

13. Indemnity

You'll defend and compensate us for claims by third parties arising from your content, your messages to your customers, or your breach of these terms or the law.

14. Law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be decided in the state or federal courts located in Orange County, California, and both of us agree to their jurisdiction.

15. Changes to these terms

We may update these terms. If a change is significant, we'll tell you by email or in Gearloom at least 30 days before it applies. Continuing to use Gearloom after that means you accept the updated terms.
